1. Acceptance of Terms

By accessing or using the Bhashafy website at bhashafy.com (“Platform”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you must not use this Platform. These Terms constitute a legally binding agreement between you and Bhashafy (“we”, “us”, or “our”).

2. Platform Description

Bhashafy is an online language learning platform that offers video-based courses, vocabulary practice, and related educational content for Indian languages. Access to certain content requires account registration and/or payment.

3. Eligibility

You must be at least 18 years of age to use this Platform. By using the Platform, you represent that you meet this requirement. If you are under 18, you must have the consent of a parent or legal guardian to use this Platform and make purchases.

4. Account Registration

To access paid content and track your progress, you must create an account. You are responsible for:

• Providing accurate and up-to-date information during registration.
• Maintaining the confidentiality of your account credentials.
• All activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or are involved in fraudulent activity.

5. Purchases and Payments

All course purchases on Bhashafy are processed securely through Razorpay. By making a purchase, you agree to Razorpay's terms of service. Prices displayed are inclusive of applicable taxes unless stated otherwise.

Upon successful payment, you will be granted "lifetime access" to the purchased course content. "Lifetime access" refers to the lifetime of the Bhashafy platform and the continued availability of the specific course.

For payment processing issues (such as failed transactions or double charges), Razorpay’s automated system will reconcile and refund the amount to your original payment method within 5 to 7 business days. For any payment gateway-related issues, please contact Razorpay support directly. Bhashafy is not liable for errors or failures that occur at the payment gateway stage. You may contact us at learn@bhashafy.com if you require assistance to escalate the issue from our end to the payment gateway provider.

6. Refunds

All sales on Bhashafy are final. We do not offer refunds once a purchase has been successfully processed and access to the course has been granted. Please read the course description carefully before purchasing.

In the event of a payment failure, duplicate charge, or transaction error at the payment gateway level, please refer to our Refund Policy for details on the payment gateway's automated refund process.

7. Intellectual Property

All content on this Platform including but not limited to video lessons, course materials, text, graphics, logos, and audio - is the exclusive property of Bhashafy and is protected under applicable Indian copyright laws and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to access and use the purchased course content for your personal, non-commercial learning purposes only. You may not copy, reproduce, distribute, share, resell, or create derivative works from any content without our prior written consent.

8. Prohibited Conduct

You agree not to:

• Share your account credentials or purchased course access with others.
• Record, download, or redistribute any course content.
• Use the Platform for any unlawful purpose.
• Attempt to gain unauthorised access to any part of the Platform.
• Post or submit content that is abusive, defamatory, or infringes on any third-party rights.

Violation of these terms may result in immediate termination of your account without refund.

9. User-Generated Content

By submitting a review or any other content on the Platform, you grant Bhashafy a non-exclusive, royalty-free, perpetual licence to display and use that content on the Platform. You are solely responsible for the accuracy of reviews and content you submit.

10. Disclaimer of Warranties

The Platform and all content are provided on an “as is” and “as available” basis without any warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. Language learning outcomes may vary and are not guaranteed.

11. Limitation of Liability

To the maximum extent permitted under applicable Indian law, Bhashafy shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Platform, even if advised of the possibility of such damages. Our total liability to you shall not exceed the amount you paid for the relevant course.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, India. 13. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to this page with an updated date. Continued use of the Platform after changes constitutes your acceptance of the revised Terms.
